By using Viewtality, you agree to the following terms and conditions.

1. ACCEPTANCE OF TERMS

By accessing and using Viewtality's website, software, and services (collectively, the "Services"), you accept and agree to be bound by the terms and conditions of this agreement.

2. DESCRIPTION OF SERVICE

Viewtality provides Remote Patient Monitoring (RPM) software solutions designed to integrate vital monitoring equipment with Electronic Medical Records (EMRs). Our services include, but are not limited to, data integration, monitoring, and billing assistance for healthcare providers.

3. USER RESPONSIBILITIES

As a user of our Services, you agree to:

• Provide accurate and complete information when using our Services
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations
• Use the Services only for their intended purpose
• Protect patient privacy and confidentiality in accordance with HIPAA regulations

4. PRIVACY AND DATA PROTECTION

Your use of our Services is also governed by our Privacy Policy. By using our Services, you agree to the collection and use of information as detailed in our Privacy Policy.

5. INTELLECTUAL PROPERTY

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are the exclusive property of Viewtality and are protected by United States and international copyright, trademark, and other intellectual property laws.

6. SUBSCRIPTION AND BILLING

Our Services are provided on a subscription basis. You agree to pay all fees associated with your subscription plan. Fees are non-refundable except as required by law or as explicitly stated in our refund policy.

7. TERMINATION

We reserve the right to terminate or suspend access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Viewtality shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. CHANGES TO TERMS

We reserve the right to modify these terms at any time. We will notify users of any material changes to these terms. Your continued use of the Services following the posting of revised Terms of Service means that you accept and agree to the changes.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
